The incident, in which Mario was allegedly racially abused by fans, came during Nice's loss away at Dijon on 10th February.
Balotelli saw his complaints about the abuse met with a yellow card from referee Nicolas Rainville who said he did not hear insults from the Dijon supporters.
This is not the first time Balotelli has claimed to experience racism in Ligue 1. At the start of 2017, Bastia fans were punished for directing monkey noises towards him following an investigation by the French football league.
The Italian struck twice on Thursday night in the Europa League against Lokomotiv Moscow. His performance was, however, upstaged by Manuel Fernandes who scored a hat-trick for the Russian side earning them a 3-2 win.
