The Spanish Football Association (RFEF) is one of the governing bodies that has to give approval for the match to take place outside of its native country Spain.
However, after RFEF chief Luis Rubiales has stood firm on his decision to reject the proposal, La Liga president Javier Tebas is willing to take the matter to court.
A spokesperson for La Liga confirmed the introduction of court proceedings into the matter. He said: "La Liga has taken a case to court in Madrid and expect a resolution in the coming days or weeks."
A decision on the case is expected around the middle of December, with the related fixture between Girona and Barcelona due to be played in January.
It is now thought that the proposal will not receive approval in time for said match, but will instead be introduced next year, pending approval.
La Liga belief that the RFEF's role in helping Real Madrid's Santiago Bernabeu venue host the second leg of the Copa Libertadores final will strenghthen its argument; the match will state a precedent for games trancesnding regional and international borders.
